By accessing, browsing, registering for, clicking to accept, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Commercial Nature of the Service

2. No Professional Advice; No Licensed Services

Bildry does not guarantee that any site, parcel, project, concept, use, layout, scope, development plan, building program, or investment is feasible, financeable, insurable, approvable, buildable, code-compliant, profitable, timely, safe, marketable, or legally permitted.

Without limitation, Bildry makes no guarantee regarding:

  • zoning classification, allowable use, setbacks, density, height, parking, overlays, variances, or entitlement outcomes;
  • permit requirements, permit timing, review comments, approvals, agency positions, or inspection outcomes;
  • code applicability, code interpretation, local amendments, utility requirements, or jurisdiction-specific enforcement;

You may not use the Service:

  • in violation of any law, regulation, contract, court order, or third-party right;
  • to misrepresent Bildry outputs as final professional determinations or official agency conclusions;
  • to reverse engineer, scrape, disrupt, overload, or interfere with the Service;
  • to upload malicious code, harmful payloads, or unlawful content;
  • to build a competing product using the Service except as expressly permitted in writing; or
  • to use automated means to access the Service except through authorized interfaces.

10. Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. You must promptly notify Bildry of any suspected unauthorized access or security incident. Bildry may suspend or terminate access at any time to protect the Service, users, data, or third parties.

11. Intellectual Property

The Service, including software, interface design, workflow logic, visualizations, text, reports, layout, branding, marks, graphics, models, calculations, compilations, and all related materials, is owned by Bildry or its licensors and is protected by applicable intellectual property laws.

Subject to these Terms, Bildry grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for your internal business purposes. No ownership rights are transferred to you.

12. User Inputs, Feedback, and Output Use

You retain rights in the data and materials you lawfully submit to the Service, but you grant Bildry a worldwide, non-exclusive, royalty-free license to host, process, reproduce, transmit, analyze, transform, and use such inputs as necessary to operate, secure, improve, support, and provide the Service.

If you provide suggestions, comments, ideas, or feedback, Bildry may use them without restriction or obligation.

Outputs may be generated automatically. You are solely responsible for reviewing and validating all outputs before any use or distribution.

13. Confidentiality and Sensitive Information

Do not upload confidential, regulated, export-controlled, classified, health, biometric, payment-card, or other highly sensitive information unless Bildry has expressly agreed in writing to handle such information. You are solely responsible for your submission choices and for obtaining all required permissions, consents, and authorizations.

14. Beta Features; Experimental and AI-Assisted Tools

Bildry may designate certain features, models, APIs, integrations, automations, or analyses as beta, preview, pilot, testing, experimental, or similar. Such features may be unreliable, incomplete, interrupted, or discontinued at any time. AI-assisted and automated outputs may contain hallucinations, omissions, false positives, false negatives, or jurisdictionally incorrect summaries.

15. Availability; Modifications; Suspension

Bildry may modify, suspend, restrict, or discontinue any part of the Service at any time, with or without notice. Bildry is not liable for downtime, outages, latency, maintenance windows, integration failures, data-source disruptions, or feature changes.

16. Fees; No Refund Obligation Except as Required by Law

If paid features are offered, you agree to pay all applicable fees, taxes, and charges. Except as expressly stated by Bildry in writing or required by applicable law, all payments are non-refundable.

17. DISCLAIMERS OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," "WITH ALL FAULTS," AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

BILDRY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, SECURITY, PERFORMANCE, SUITABILITY, OR RESULTS.

BILDRY DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, CURRENT, SECURE, COMPATIBLE WITH ANY PARTICULAR WORKFLOW, OR FREE OF DEFECTS, VIRUSES, OR HARMFUL COMPONENTS.

18. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BILDRY, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTRACTORS, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, RELIANCE, CONSEQUENTIAL, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, BUSINESS OPPORTUNITY, PROJECT VALUE, FINANCING, ENTITLEMENT OPPORTUNITY, OR EXPECTED SAVINGS, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF BILDRY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO BILDRY FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

THE LIMITATIONS IN THESE TERMS APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, STATUTE, OR OTHERWISE, AND REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

  • your reliance on or use of any output;
  • your project, investment, acquisition, permitting, design, construction, underwriting, financing, or compliance decisions;
  • your inputs, uploaded content, data, or materials;
  • your violation of these Terms; or

20. Time Limit for Claims

To the maximum extent permitted by applicable law, any claim or cause of action arising out of or relating to the Service or these Terms must be brought within one (1) year after the claim arose, or such claim is permanently barred.

21. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Service or these Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent such selection is prohibited by applicable law.

Subject to any applicable arbitration provision, you agree that the exclusive venue for any action not required to be arbitrated shall be the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

22. Optional Arbitration and Class Action Waiver

To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the Service or these Terms may, at Bildry's election, be resolved by binding individual arbitration rather than in court, except that either party may seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, or platform security.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BILDRY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, MASS ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING.
